SCHEDULED INSIDE NEGOTIATIONS
BETWEEN IBEW 640/NECA
COME TO A CLOSE 4.24.08
Hello Brothers and Sisters. There was a negotiating meeting on Friday, April 18, and again on April 22, 2008 at 3pm. Local 640 and Arizona Chapter, NECA met at the Dale Eastridge Training Center (PEJATC) for our last regular-scheduled negotiations meeting. In a meeting lasting nearly 3 hours, the parties were able to dispose of all but four items. We have scheduled an extra negotiating meeting for Tuesday, April 28, after the Local 640 special meeting on Monday night at 6pm. There is also an interim meeting scheduled with the NECA District Representative and IBEW 7th District Representative on May 8. Following is a summary of the overall outcome so far. (Please share with your Brothers and Sisters who don’t have computers).
Items tentatively to be scheduled for CIR:
*Length of Agreement
*Local 640 Wage Proposal (no counter from Employers)
*All Regular Scheduled Hours Worked Before Overtime Paid
*Saturday may be used as Makeup Day
Local 640 Original Proposals:
*Change the name of the Credit Union Deduction to “Credit Union Vacation Deduction” and add the option for members to withhold 5% or 10% towards their vacation.

*Add a voluntary IBEW/COPE deduction option of $5 per week. (WITHDRAWN)
*Add Category One Language enabling the Code of Excellence

*Change the notice on the 4-10’s work schedule to be 48 hours notice to the employee and the Union, and codify that working a make-up day is optional. (COUNTERED THEN WITHDRAWN)
*Change the rate at which an employee is paid for using their own vehicle to be “the most recent IRS yearly Standard Mileage Rage per mile” (currently $.505/mile) (COUNTERED, MODIFIED, AGREED)
*Change the contribution rate to the JATC to “at least $.30 per hour” as of June 21, 2009. (COUNTERED, MODIFIED, AGREED)
*Index the Annuity to 4.5% of gross wages instead of a set dollar amount. (WITHDRAWN)
*Create a new MOU creating a “15 Day Call” (short call). (AGREED)
*Create a new MOU that addresses the method for an individual to request being removed from the Do-Not-Hire List (already in practice). (AGREED)
Arizona Chapter, NECA Original Proposals:
*Eliminate payroll deduction for working dues (WITHDRAWN)
*Increase the dollar amount required at which a sign has to be posted on a construction and maintenance job (from $10,000 to $400,000), and remove the requirement for all company vehicles to have the firm’s name.

*Eliminate the Credit Union Deduction (WITHDRAWN)
*Change the notification requirement to the Union for jobs awarded from $375,000 to $1,000,000. (COUNTERED, MODIFIED, AGREED)
*Require 40 hours worked, or an employee can be replaced on overtime.(WITHDRAWN)
*Eliminate shift pay.(WITHDRAWN)
*Make termination slips in quadruplicate instead of triplicate, with the extra copy going to NECA. (WITHDRAWN)
*Change requirements to define High Time by adding the requirement “…is not provided a 100% fall protection plan and the proper safety equipment.” Also eliminate the Hazard Pay for injurious gas, dust, or fumes. (WITHDRAWN)
*Eliminate the $30 payment for Article 7.03(b). (WITHDRAWN)
*Eliminate the age ratio requirement of Section 7.14(c) b. covering order of referral. (WITHDRAWN)
*Add a battery drill and charger (3/8”) to the tool list. (WITHDRAWN)
*Remove conditions 4,5, and 6 from Section 2.20(b) regarding Foreman call-by-name. (COUNTERED, MODIFIED, AGREED)
*Adopt Category One Language Enabling the Code of Excellence. (AGREED)
*Make it mandatory for all contractors to use the “One-Check” payment system for all trust funds (including the Receiving and Administration Fund). (COUNTERED, MODIFIED, AGREED)
*Assurance that the Union will do its best to refer only legal-status workers to the contractors. Allowance for the contractors to go outside the Union to man their work. Allowance for the contractors to permanently keep any temporary workers they hire off the street. Use of “Contracted Labor” with proper notification of names and locations of work by the contractor. (WITHDRAWN)
*Modify Section 3.20 to address CW/CEs instead of IJs. Implement the tiered Health and Welfare Plan for Warehousemen.

*Modify Section 3.15 that a workman will not be paid his wages immediately unless all company equipment and supplies have been returned. (WITHDRAWN)
*JW call-by-name provided the employee has been employed by the contractor in the past 12 months and not quit his previous employer in the past 2 weeks. (WITHDRAWN)
*Change the allowed variance in job starting time from two hours to three hours and eliminate the requirement to notify the Union.

*Add a new section tying the Agreement and all MOUs to the grievance procedure. (WITHDRAWN)
*Adopt Category One Substance Abuse language. (AGREED)
*Eliminate the “Health Maintenance Check” (2 hours of pay) for drug testing from the Substance Abuse MOU. (WITHDRAWN)
*Begin the process of eliminating the Pension Plan and rolling it into the Annuity when appropriate benchmarks are met. (THIS TURNED OUT NOT TO BE AN AGREEMENT TO ELIMINATE THE PENSION PLAN, BUT TO BEGIN EXAMINING THE POTENTIAL UPS AND DOWNS OF EXITING THE PLAN.
